Construction Contract Law

We review and negotiate construction contracts from both regional and national homebuilders, representing the homeowner’s interest in achieving an equitable deal. Our attorneys have broad experience in all aspects of real estate law as it relates to construction.

AIA Documents

When a builder, architect or contractor begins work on a job, the contract documents are typically created according to standard documents from the American Institute of Architects (AIA). We work extensively with the entire series of AIA documents. We can represent an owner in reviewing and revising Standard Form of Agreement between an owner and contractor where basis for payment is cost plus a fee with a guaranteed maximum price (AIA Document A111). We have also assisted with creation of General Conditions (AIA Document A201) and prepared comprehensive Amendments to address additional issues.

Bank Financing Documents for Construction

Our attorneys are well versed in all aspects of banking, finance, and lending law and the specific regulations relevant to construction financing. We represent general contractors, architects and engineers with regard to negotiating Agreements to Complete and other bank financing documents.

Joint Venture and Construction Teaming Agreements

When partnering with another entity on a construction project, negotiating a joint venture or teaming agreement may serve to protect both parties, and may even be mandated by the purchaser. Where a teaming agreement will typically have one prime contractor and a subcontractor performing certain agreed upon duties, a joint venture agreement has greater flexibility. We advise SBA 8(a) construction contractors, Veteran-owned companies and HUBZone businesses in negotiating joint venture and construction teaming agreements and contract issues.
